Judge Zoe Doralina Guifarro, following the order issued in June 2022, restored due process to the accused, whose case had previously been dismissed by the Court with National Territorial Jurisdiction in Criminal Matters.
According to a statement from the Judiciary, this ruling not only recognizes the validity of the actions carried out by said Court , but also, in accordance with the principles of justice, loyalty and good faith, complies with the ruling of the Constitutional Chamber of the Supreme Court of Justice (CSJ), which in June 2022 ruled in favor of the accused.
Beneficiaries
Among those who benefited from this sentence are: Juan Antonio López (QDDG), Carlos Leonel George George, Reynaldo Domínguez Ramos, José Adaly Cedillo Mendoza and Marco Tulio Ramos, who had been accused by the Prosecutor’s Office of crimes such as unjust deprivation of liberty, aggravated arson, robbery and illicit association to the detriment of Santos Hernández Corea, the company Los Pinares SA de CV, and the Internal Security of the State of Honduras.
Detention
The environmentalists, members of the Municipal Committee for the Defense of Public Property of Tocoa, were arrested in 2019 for their opposition to the mining project of the company Inversiones Los Pinares (ILP).
Proponents argued that the project would affect protected areas and the Guapinol and San Pedro rivers.
This appeal was granted by the Constitutional Chamber of the CSJ , which allowed the dismissal of the accused.
With the issuance of the final release letters by the Tocoa Sectional Court of First Instance, all related proceedings are archived, thus closing the case definitively.
