The co-founder of the Sinaloa Cartel, Mexican Ismael “Mayo” Zambada , is eligible for the death penalty after being arrested on U.S. soil, although it will be up to the highest judicial authorities to authorize it before the start of the trial or not, it was announced on Friday in the court that is investigating his case.

With a beard and a thick mustache and the white roots of his thick hair overshadowing the black hair he sported in his first court appearances, Zambada appeared Friday before Judge Brian Cogan, who is investigating his case in the East Federal Court in Brooklyn.

A new hearing has been set for January 15.

During the hearing, the prosecution confirmed to Judge Cogan that Zambada’s case is punishable by death , but it must be authorized by the Attorney General, the equivalent of the Minister of Justice, before the start of the trial.

If the Attorney General authorises the maximum penalty, the criminal phase of the trial will be held and the same jury that found him guilty will decide whether he should be sentenced to death or life imprisonment , judicial sources confirmed to AFP.

Current Attorney General Merrick Garland declared a moratorium on federal executions shortly after taking office in 2021, in contrast to his predecessor under Donald Trump who carried out a dozen in six months.

Case against ‘Mayo’ Zambada

The co-founder of the Sinaloa Cartel in the 1980s along with Zambada, Joaquín “Chapo” Guzmán , was sentenced in the United States by the same judge Brian Cogan to life imprisonment since the extradition agreement excluded the eventual death penalty.

Zambada pleaded not guilty on September 14 to the 17 charges brought against him by the U.S. courts, including continuing criminal enterprise, murder and arms trafficking.

He was also charged with drug trafficking , particularly fentanyl, a powerful narcotic 50 times more potent than cocaine, which causes tens of thousands of overdose deaths each year in the United States.

The Mexican drug lord was arrested on July 25 in New Mexico when he landed in a small plane with Joaquin Guzman Lopez, son of “El Chapo.”

Zambada said he was the victim of an ambush and tricked by Guzmán López, also known as “Chapito,” into being brought to the United States by force and that he would seek judicial advantages for himself and his brothers, whose cases are being investigated in a court in Chicago, Illinois (north).
